A typographer has filed a legal suit against Banana Republic over its stylized ampersand used across the fashion retailer’s ads.
Moshik Nadav claimed that Banana Republic has been appropriating his typographic property on a global scale without a commercial license. Nadav, who owns typography firm
Moshik Nadav Typography LLC, said that his elaborated ampersand is part of his Paris Pro font family.
In a side-by-side comparison shared by
Creative Bloq, Banana Republic’s ampersand looks indiscernible from the one Nadav designed, except that the fashion brand’s version is dressed in gold glitter.
Nadav said Banana Republic has failed to seek permission over the use of the ligature before using it across “extensive digital marketing and on worldwide social media platforms.” The designer is seeking damages amounting to US$75,000 or more.
According to Nadav’s legal document, “No other font or typeface includes the same artistic ligature and logograms set forth in the Paris Pro FS and Paris Pro Typeface.” It also stated that Nadav “spent countless hours creating and perfecting these artistic ligatures and logograms.”
