The manufacturer of hard seltzer White Claw, Mark Anthony Brands International, has recently filed a lawsuit against a California-based company for trademark infringement. As per a report by
TMZ, the business had allegedly been selling candles made out of empty White Claw cans.
According to Complex, the suit said that the company – Fun Club, LLC – removed the tops of empty White Claw cans, upcycling them into candles by pouring wax and inserting a wick.
White Claw’s lawsuit is seeking to stop the sale of these candles, as it says it may damage the brand’s reputation should “an improperly labeled, insufficiently insulated or defectively manufactured candle with its logo ends up burning someone or causing a fire.”
Not only is White Claw looking to cease Fun Club’s production, it’s also seeking any profits Fun Club had earned from the sale of the candles. The company’s owner, Caitlin Minges, told
TMZ that Fun Club had already stopped production following a cease and desist, but wasn’t aware of the lawsuit till news broke.
“It is unfortunate that White Claw dislikes recycling and is using its enormous resources as a massive company to go after small women-owned businesses who are attempting to make something functional out of their garbage,” Minges said.
While it’s unclear how this lawsuit will turn out, it may become a worry for other upcycling businesses that re-use other brand’s items.
