Jack in the Box and the man in the Moon aren’t seeing eye to eye. The San Diego-native fast-food chain
is suing renowned cryptocurrency exchange FTX for introducing a character it believes is a knockoff of its own,
Insider reports.
The eponymous Jack Box has been a familiar American face for 70 years with his spherical head, dotted eyes, and beaming smile. So it comes as no surprise that, when FTX debuted its ‘Lou Nar, the Moon Man’ mascot with a similarly round head, blue dot eyes, and cheerfully vacant smile last month, viewers were struck by déjà vu.
Jack in the Box was too, going so far as to deliver a 24-page legal document railing against this lookalike.
It’s worth noting that both faces are tied to baseball. FTX’s Lou Nar, for example, made his first appearance at the Major League Baseball playoffs and has
caught games at Dodger Stadium this year, with FTX even dedicating US$10,000 to the charity represented by any player who’d succeed a “moon shot.”
As for Jack Box, he
threw his first pitch at the Dodgers Game in 2015.
Jack in the Box calls the Moon Man “a far inferior version of Jack,” and is accusing FTX of “tarnishing Jack's reputation to consumers.” The chain says that the crypto platform could have designed a wholly original mascot from its “vast financial resources,” but instead, “knowingly,” “brazenly and illegally copied or derived” from the longstanding mascot.
While you can’t always objectively determine if one mascot is “inferior” to another, Jack in the Box has relied on social media comments to back its claims. Per the lawsuit, it’s cited a user who described the Moon Man as “Jack in the Box’s drugged-up cousin,” and another who remarked: “This guy is not the moon, this is Jack in the Box gone off the percs.”
The chain is asking for monetary damages and an injunction to prevent FTX from bringing out the mascot again.
