Lizzo is now “100% THAT Bitch”—officially. The United States Patent and Trademark Office (USPTO) has given the rapper the go-ahead to use the iconic phrase as a federal trademark.
This means, going forward, Lizzo will be able to use the Truth Hurts lyric on apparel and merchandise, with the agency ruling that the phrase would be perceived as associated with the singer rather than “a commonplace expression.”
The trademark application had previously been rejected by the USPTO but was eventually overturned by the Trademark Trial and Appeal Board (TTAB), which cited that all evidence of third-party use of the phrase came after the song was released.
Intriguingly, the Urban Dictionary was used in the ruling, with the TTAB noting that the entry for the term was dated June 12, 2019, “contemporaneous with or subsequent to the release of Lizzo’s hit single Truth Hurts.”
