Nando’s Turns Up Heat On Chicken Restaurant With Copyright Infringement Claims

A chicken restaurant in Oxford, Reading, is in a fiery situation with Nando’s, who claims that the former has copied its branding.
The accused, Fernando’s, says that Nando’s lawyers have sent it a letter asserting that it has infringed on the major chain’s intellectual property rights with the use of “highly similar” imagery in its store and menus, including a rooster mascot.
Apart from the ‘Barcelos Cockerel’ trademark, Nando’s alleges that Fernando’s mimicked its ‘PERi-ometer’—a rating scale for the spiciness levels of Nando’s menu items.
It also claims Fernando’s brand name is too close to the peri peri chain’s.
Fernando’s director, Asam Aziz believes that Nando’s is bullying him into changing the name of his restaurant.
“For the moment I’m left aghast,” says Aziz. “I really don’t know what to do, to be honest with you, because we had no intention of copying Nando’s.”
“We wanted to sell peri peri chicken. Being of Portuguese origin, we use the [image of a] chicken, which I believe is a Portuguese chicken, and the name Fernando’s is a Portuguese name.” Aziz also assures that Fernando’s name was inspired by a popular television show called Take Me Out.
He adds that he has poured “every penny” into his business, and having to redesign all of Fernando’s branding collaterals would be a struggle.
“They are just trying to bully me because my chicken is better than theirs!”
The business owner has since arranged appointments with intellectual property experts to advise him on “whether I’ve got any leg to stand on or whether the bullies can bully me into changing my name.”
A Nando’s spokesperson responds, “We have asked this restaurant to rebrand because we believe it is trying to benefit from some of things that make us who we are—our menu, logo and even our name.”
