Nike’s ‘Just Do It’ tagline has permeated pop culture and is probably one of the most recognized slogans in recent history.
So much so, that one Texas-based company, Revive Farming Technologies, which specializes in cannabidiol (CBD) production, has employed a familiar ‘Just Hemp It’ phrase as a slogan for its own products.
The farming company applied for the ‘Just Hemp It’ trademark in 2019 for use on hemp paper products, vape cartridges, boxes, and other items. If you visit its website, you will see the header in huge block letters, marked with a “TM.”
Of course, the sportswear giant owns the rights granted by the federal registrations and common law rights to the ‘Just Do It’ slogan. In Nike’s opposition filing, the company stated that the mark has been used for over 30 years and is famous within the meaning of the Lanham Act. It added that the Texas hemp company’s phrase would only confuse customers.
Nike has alsoasked the Patent and Trademarked Office and Trademark Trial and Appeal Board to deny the application by Revive Farming Technologies.
After the case was made against Revive Farming Technologies, Nike cited that it has successfully taken action against many other companies for trying to use other variations of the phrase.
