Google Bows To Settling Browser Incognito Mode Class-Action Battle

Google has recently agreed to settle a class-action lawsuit regarding its Chrome browser’s Incognito mode. The dispute, initiated in 2020, accused the tech giant of tracking and gathering user data even when users opted to surf the web in perceived secrecy.

 

Several plaintiffs in the lawsuit alleged that despite opting for what they thought was a private browsing option, their data was still being collected through Google tools like Analytics and Ad Manager. They argued that this ongoing data collection breached privacy and wiretap laws, as users were not fully aware or consenting to such tracking.

 

The legal proceedings took a significant turn when Judge Yvonne Gonzalez Rogers denied Google’s bid for a summary judgment in August, emphasizing that the tech giant had not sufficiently informed users about the continuation of data collection in Incognito mode.

Google had previously sought dismissal of the lawsuit, justifying some level of visibility by pointing to the message it displays when users trigger Incognito mode.

 

The settlement, which requires final approval by a federal judge in Oakland, is set for review by February 24, 2024. While the terms of the settlement, including any financial compensation, have not been disclosed, the lawsuit had originally sought US$5,000 in damages per user for alleged violations of federal and California privacy laws.

 

This case underscores the complex landscape of digital privacy and user consent, and highlights the importance of clear communication from tech companies regarding data collection practices and the need for users to understand the limitations of privacy features like Incognito mode.
